  • PARTIES TO THE AGREEMENT


This "AGREEMENT" is entered into, by and between, Aanew (“Aanew”) and "GUEST" (see below).  Aanew is a limited liability company, duly organized and existing under the laws of the State of Nevada, with a mailing address at 2764 North Green Valley Parkway, #329, Henderson, NV 89014.

  • USE AGREEMENT

GUEST would like to purchase a set number of nights to be used at an Aanew property.  GUEST agrees to vacate the Aanew property of choice (hereinafter referred to as ESTATE) upon the completion of their time and understands that any presence on the property after their time will be considered trespassing and will be turned over to the authorities accordingly.

GUEST understands and agrees that the ESTATE is a privately held property, as opposed to a hotel, resort or the like. Aanew has the sole right to market, maintain, and lease any and all properties within its inventory.

 

  • USE REQUIRMENTS
    • Primary GUEST must be at least 25 years of age.  GUEST will be personally, legally, and financially responsible for the terms of the AGREEMENT. GUEST will be responsible for and must abide by all Clark County, Nevada State, and Federal laws; including, but not limited to, underage drinking, noise ordinances, etc... Evidence of unauthorized or illegal activity within the property will be grounds for immediate eviction without refund and the complete forfeiture of the security deposit. Aanew reserves the right to refuse service at any time.
    • GUEST agrees to present a valid form of identification as well as a valid credit card upon check-in at the ESTATE. Identification will be used to confirm qualifications for rental as stated in Section 3(a). The credit card will be used to cover any amenities used and/or damages incurred above and beyond the Security Deposit.  Aanew reserves the right to refuse service if GUEST cannot provide a valid form of identification and a valid credit card without refund.
    • GUEST understands that adult supervision is required for children at all times throughout the property. Safety is expected from all of the individuals that the GUEST permits on the property; but, especially, when using the swimming pool, spa, water features, and/or pool table. Child safety is the sole responsibility of the GUEST.

 

Please note: Although the ESTATE is gated, there are not separate gates distinguishing the pool and/or spa from the yard at large.  It is the sole responsibility of the GUEST to maintain the safety of all child and adult members of their party at all times.

 

Aanew waives any responsibility and liability for accidents which may arise from use of the swimming pool, spa, water features, pool table, or any other parts of the ESTATE.  In addition, Aanew waives any responsibility for accidents which may arise due to negligence, inebriation, or misuse by GUEST or any members of their party, and/or due to any hazardous conditions; including but not limited to water, ice, or snow.

 

    • GUEST understands that there is NO street parking at the ESTATE. All associated vehicles must fit within the designated parking areas on the ESTATE.
    • Upon check-out, GUEST shall surrender the ESTATE in as good a state and condition as it was at check-in; with the exception of reasonable use and wear-and-tear of the property.

GUEST is responsible for all activity, visitors, and vendors on the ESTATE during the temporary use period; including but not limited to all penalties, damages, misuse, and illegal activity conducted by said visitors and/or vendors.

GUEST must remove all personal belongings, rental equipment, and/or guests from the ESTATE before check-out will be confirmed. GUEST understands that they will be charged $200 per hour for every hour they, or any associated equipment or individuals, remain on the property after their scheduled check-out.


 

  • INCLUDED IN RATES
  • Nightly Rate
    • Cleaning Fee: $500 final cleaning fee
  • Security Deposit: A $3000 security deposit is required for all stays; to be paid in one of three ways
      • Included with payment of rental rate
      • Paid in cash at check-in
      • Paid via credit card; processed by Aanew 24 hours prior to check-in (24 hours to allow for approval)
    • GUEST permits Aanew to subtract any owed amenities, charges, or fees from the pre-paid security deposit.  GUEST further authorizes Aanew to process any owed amenities, charges, or fees above and beyond the security deposit to the credit card provided at check-in.  A detailed accounting of all charges and fees will be sent to the GUEST via the email address provided within 15 (fifteen) days of check-out.  The remaining security deposit will be refunded to the GUEST, as applicable, via check or refunded to the credit card used within 15 (fifteen) days of check-out.

 

  • SPECIFIC USE CHARGES

 

  • Daily Rent: ____________________________________________________________ per night

  • ADDITIONAL AMENITIES AND FEES

 

  • Late Check-In
    • $250 for after hour check-ins between 7pm and 12am
    • $500 for after hour check-ins between 12am and 8am
  • Late Check-Out
    • $200 per hour for every hour GUEST remains on the property after their scheduled check-out time.  This requirement includes GUEST, their personal belongings, rental equipment, and/or other individuals with GUEST.
  • Event Rental
    • $2,000 per event or gathering that brings more than 20 people onto the property.  Events are only allowed on certain properties and must be pre-approved by Aanew; fee included with original rental fee.
  • Unauthorized Event Fee
    • $3,000 Fee - A normal rental includes accommodations for up to 20 individuals on the property.  Any events that host more than 20 people on the property must be prearranged and approved by Aanew LLC (not all properties will accommodate an event).  The Unauthorized Event Fee will be charged each time the GUEST does not receive permission to hold an event with more than 20 people on the property.  Additional damages above and beyond the Unauthorized Event Fee will be detailed and charged to the credit card provided by the GUEST as authorized in Section 5.
  • Maid Service
    • $50 per hour - Daily housekeeping is included for free with each rental and includes making of beds, cleaning of bathrooms, replacement of towels and linens as needed (approximately 1 hour of service between 10am and 2pm).  A closed bedroom door will signify that occupant does not want room cleaned.  GUEST can request and pay for additional maid services at $50 per hour (pre-approval required).  Additional services to include cleaning of kitchen, dishes, floor, common areas, etc…
  • Extra Cleaning Fee
    • $250 Fee - Will be charged if GUEST leaves excessive trash, dishes, or debris throughout the property; including but not limited to trash, dishes, and cigarette butts on the grounds outside the property.  Upon check-out, all dishes and kitchen items should be loaded into dishwasher (dishwasher should be set to run), property furniture and items returned to their original position, all personal items should be removed from the property (including but not limited to rental equipment), the BBQ should be cleaned and returned to original condition, and all garbage should be deposited into large garbage cans.
  • Property Damage
    • GUEST understands that they will be charged for any damage to the ESTATE that is above and beyond normal wear and tear (i.e. damage to felt from standing on pool table, scratches on piano from sitting on the lid, etc…).  GUEST will be charged the replacement, repair, and/or labor fees requirement to return item to condition at check-in.

 

PLEASE NOTE: The following fees are for pervasive actions that can affect the property as well as the medical well-being of future guests.  Evidence of the following actions will result in a minimum of: cancellation of rentals for 3 days, professional cleaning of carpets, upholstery, and drapes, cleaning and/or replacement of all bedding, removal of particulate matter, cleaning of floors and walls, plus any other measures to correct the damage.

  • Smoking Fee
    • $3,000 Fee - The ESTATE is a NON SMOKING property. Smoking is not allowed on the property for any reason. Unauthorized smoking will be grounds for immediate eviction without refund. Evidence of smoking (including but not limited to cigarette butts, burn marks, pervasive cigarette smell, etc…) discovered after check-out will result in the charge of the $3000 Smoking Fee.  Additional damages above and beyond the Smoking Fee will be charged to the credit card provided by the GUEST as authorized in Section 5.  
  • Latex Fee
    • $3,000 Fee - The ESTATE is a LATEX-FREE property (i.e. no latex balloons, latex gloves, etc...).  Unauthorized use of latex balloons (products) will be grounds for immediate eviction without refund. Evidence of use (including but not limited to balloon remnants, security footage, etc…) discovered after check-out will result in the charge of the $3000 Latex Fee.  Additional damages above and beyond the Latex Fee will be charged to the credit card provided by the GUEST as authorized in Section 5. Note: Small, personal latex items are ACCEPTABLE (i.e. hair bands, condoms, etc...).
  • Pet Fee
    • $3,000 Fee - The ESTATE does not allow PETS on the property for any reason. Unauthorized pets will be grounds for immediate eviction without refund. Evidence of pets (including but not limited to pet hair, chew marks, urine stains, security footage, etc…) discovered after check-out will result in the charge of the $3000 Pet Fee.  Additional damages above and beyond the Pet Fee will be detailed and charged to the credit card provided by the GUEST as authorized in Section 5.

 

  • CANCELLATION POLICY
  • More than 60 Days before Check-In: GUEST can cancel reservation and receive a full refund.
  • Between 60 and 30 Days of Check-In: No refunds are available; however, GUEST has the option of transferring reservation dates to another available date (with comparable pricing) within 12 months of original reservation.
  • Within 30 Days of Check-In: No refunds and no reservation transfers are available.

 

  • INDEMNIFICATION
    GUEST shall at all times during the term of this AGREEMENT, and thereafter, indemnify, defend, and hold harmless Aanew, its directors, officers, employees and affiliates, as well as the property owners and/or investors against all claims and expenses, including legal expenses and attorneys’ fees whether arising out of the death of or injury to any person or persons, out of any failure to comply with applicable laws or regulations, including without limitation those relating to discrimination in the offering of accommodations, or out of any damage to property and against any other claim, proceedings, demand, expense and liability of any kind whatsoever arising from GUEST’S rent and activities on the ESTATE.

 

  • FORCE MAJEURE

If either party hereto is materially hampered from performing hereunder by reason of any law, natural disaster, labor controversy, war or any similar event beyond a party's reasonable control ("Event of Force Majeure"), failure to perform shall not be deemed a breach of or default under the AGREEMENT and neither party shall be liable to the other therefore.  Aanew shall have the right to suspend the AGREEMENT during an Event of Force Majeure and shall have the right, but not the obligation, to extend this AGREEMENT by the length of any such suspension. Either party may terminate the AGREEMENT in an Event of Force Majeure which incapacitates Aanew for more than three (3) continuous months without further liability to the other party, except for appropriate payment or adjustment with respect to any services satisfactorily completed prior to such termination.

  • ENTIRE AGREEMENT

This AGREEMENT contains the entire understanding of the parties with respect to its subject matter. There are no other agreements other than those expressly set forth herein. This AGREEMENT cannot be modified except by a written instrument signed by both parties.  Further, this AGREEMENT supersedes any and all other agreements, either oral or in writing, between the parties with respect to its subject matter.

  • SEVERABILITY

If any provision of this AGREEMENT is held by a court of competent jurisdiction to be invalid, void, or unenforceable, the remaining provisions shall nevertheless continue in full force without being impaired or invalidated in any way.


 

  • DISPUTE RESOLUTION

In the event any dispute or claim arises out of or relates to this AGREEMENT and Aanew and GUEST are unable to settle the dispute, the parties agree to submit the dispute to final and binding arbitration administered by the National Arbitration Forum (www.arb-forum.com) under its Code of Procedure then in effect.  Aanew and GUEST agree that any dispute arising out of this AGREEMENT shall be within the jurisdiction of Clark County Superior Court in the State of Nevada.  The parties agree to select an arbitrator who is familiar with the rental industry and agree that judgment on the award rendered by the arbitrator may be entered in any court of competent jurisdiction.

In the event GUEST initiates a claim against Aanew in arbitration, litigation, or other dispute resolution proceeding, and GUEST is not awarded damages in an amount greater than the highest amount Aanew offers GUEST in writing, GUEST agrees to reimburse Aanew for the costs and fees, including reasonable attorney’s fees, incurred by Aanew in defense in such proceeding.

  • LIMITATION OF LIABILITY

Where permissible under state law, the liability of Aanew under any theory of liability (i.e. negligence, breach of contract, consumer protection, etc...) shall be limited to the rent(s) paid by GUEST for the rental period.  This section is not applicable in those states where limitations on liability are expressly and absolutely prohibited.  Otherwise, the limitations set forth in this section shall be binding upon GUEST and anyone else who may otherwise initiate an action through GUEST against Aanew.

  • TIME LIMITATION

Any dispute or claim initiated against Aanew must be made within one (1) year of the date of the rental check-out. This time period may be shorter than otherwise provided for under the laws and regulations of some states.
